Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and SilicaSites LLC (“SilicaSites”, “we”, “us”, “our”) for your use of BOOKDAH, including the website, customer accounts, business portal, APIs, and related services (together, the “Service”). BOOKDAH is a product operated by SilicaSites LLC (SilicaSites LLC - registered in Wyoming, United States), serving users primarily in the Caribbean.

1. Platform role

BOOKDAH is an online scheduling and discovery platform. We help customers find businesses and request appointments or rentals in the Caribbean. We are not the provider of the underlying service (for example a haircut or tutoring session). Contracts for those services are between the customer and the business. Local businesses remain responsible for their own licensing, trade rules, and delivery. We do not employ listed businesses and do not guarantee their work or conduct. A “Verified business” badge on BOOKDAH means we marked the listing as platform-verified; it is not a government license, regulatory approval, or identity background check.

2. Eligibility

You must be at least 18 years old and able to enter a binding contract. Business accounts must represent a real business or sole trader offered lawfully where they operate. You may not use the Service if we have previously suspended or banned your account.

3. Accounts

• Customer accounts - browse listings, request bookings or rentals, message about appointments, leave eligible reviews, and manage your account.
• Business accounts - publish a profile, list services or rentals, set availability, manage bookings, message customers, and optionally subscribe to paid plans.

You must provide accurate registration information and keep credentials confidential. You are responsible for activity under your account. Notify us at info@silicasites.com if you suspect unauthorised access. We may refuse registration, require identity checks, or limit features where needed for security or compliance.

4. Bookings, cancellations, and no-shows

• A booking request is not confirmed until the business accepts it, unless the business's settings provide otherwise.
• Customers and businesses must provide accurate details and honour commitments or cancel according to stated policies.
• Businesses may publish free-cancellation windows or other rules. Those rules are set by the business; BOOKDAH displays them for convenience and does not guarantee every shop will honour them.
• Businesses may mark an appointment as completed, cancelled, or no-show as provided in the product. Customers may use available dispute tools where offered. Outcomes of disputes between users are not guaranteed.

5. Messaging and user content

Messaging is limited to booking-related communication. Reviews, replies, profile text, photos, and messages are “User Content.” You retain ownership of your User Content. You grant SilicaSites LLC a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute that content as needed to operate, promote, and secure the Service.

You represent that you have the rights to submit User Content and that it does not violate law or third-party rights. We may remove or restrict User Content, and we may keep or delete reviews after an owner report or automated moderation flag, according to our review process. See also our Community Guidelines.

Reporting messages. Customers and businesses may report messages that appear to violate these Terms or the Community Guidelines using in-product report tools. When you submit a report, you authorise us to receive the reported message and nearby chat context so moderators can review it. We may retain report snapshots (including after a message is deleted) for safety, abuse prevention, and legal compliance. We have the right - but not the obligation - to investigate reports, remove content, warn or suspend accounts, or take no action. False, retaliatory, or abusive reports may themselves lead to enforcement action. BOOKDAH is not an emergency service; if someone is in immediate danger, contact local emergency services.

6. Business listings

Business owners agree to:

• Publish accurate names, locations, hours, and prices.
• Offer only services they are legally allowed and competent to provide where they operate.
• Respond to requests professionally and without unlawful discrimination.
• Not use BOOKDAH for fraud, spam, adult exploitation, illegal goods/services, or other prohibited activity.

We may edit visibility, remove listings, suspend accounts, or withhold features when Terms are breached or users face risk.

7. Acceptable use

You must not:

• Harass, threaten, defame, or impersonate others.
• Scrape, bulk export, reverse engineer, or disrupt the Service except as allowed by mandatory law.
• Upload malware, spam, or illegal content.
• Circumvent security, rate limits, billing, or access controls.
• Use automated means to create accounts, book slots abusively, or manipulate reviews.

8. Fees and payments

Platform fees.Businesses may use free or paid subscription plans. Prices on our pricing page (or Checkout) apply at the time of purchase and are typically shown in Trinidad and Tobago dollars (TTD) for our Caribbean market. Subscriptions renew according to the terms shown at checkout or in the billing portal until cancelled. Taxes may apply. Payment processing for subscriptions is handled by Stripe; Stripe's terms also apply to that payment. Unless we state otherwise at purchase, paid plan fees are non-refundable after the billing period starts; you may cancel future renewals in the billing portal (cancel at period end).

Service fees between users. Payment for the appointment or rental itself is between customer and business unless we expressly offer in-product customer payment for that item. We are not a party to that payment.

8A. Currency and estimated exchange rates

Businesses on BOOKDAH are responsible for establishing the prices and currencies applicable to their services, rentals, products, and other offerings. The currency displayed as the primary price on a listing is the currency in which the business has established that price.

BOOKDAH may display an estimated equivalent value in another currency based on exchange-rate information obtained from third-party sources. These converted values are provided for informational and convenience purposes only and are indicated as estimates where applicable.

Estimated currency conversions are not guaranteed prices, payment amounts, exchange rates, or settlement amounts. Actual amounts charged, received, refunded, or otherwise settled may differ due to changes in exchange rates, payment-provider conversion rates, bank rates, card-network rates, foreign-exchange spreads, taxes, fees, commissions, or other charges.

BOOKDAH does not guarantee that an estimated currency conversion is complete, current, exact, or identical to the rate that may be applied by a payment provider, bank, card issuer, financial institution, or other third party. The original price and currency established by the business remain authoritative unless the applicable transaction explicitly states otherwise.

Where a transaction is processed through a third-party payment provider, the payment provider's applicable currency, exchange rate, fees, and final charged amount may differ from any estimated conversion displayed by BOOKDAH. Users are responsible for reviewing the applicable price and currency before completing a transaction. BOOKDAH may temporarily suspend or omit estimated currency conversions when reliable exchange-rate information is unavailable.

8B. Business pricing responsibility

Businesses are responsible for ensuring that the prices, currencies, fees, taxes, availability, and other commercial information they publish on BOOKDAH are accurate and applicable to their offerings. BOOKDAH does not independently guarantee the accuracy of prices supplied by businesses. Businesses must not rely on BOOKDAH's estimated currency conversion as a substitute for establishing the actual price they intend to charge.

8C. No foreign exchange service

BOOKDAH's currency conversion functionality is provided solely to help users understand prices across different currencies. Unless expressly stated otherwise, BOOKDAH does not provide foreign-exchange, currency-trading, remittance, banking, or financial conversion services merely by displaying estimated currency equivalents.

8D. Exchange rate changes

Exchange rates may change continuously. An estimated currency equivalent displayed by BOOKDAH at one time may differ from an estimate displayed later for the same price. This does not by itself constitute a change to the underlying business price.

8E. Payment processing and currency

Where payments are processed through a third-party payment provider, the applicable payment provider terms, supported currencies, exchange rates, fees, and settlement rules may apply. The currency estimate displayed by BOOKDAH should not be interpreted as a guarantee of the final amount charged or received through a payment provider.

9. Intellectual property

SilicaSites LLC and its licensors own BOOKDAH, including software, design, trademarks, and documentation. Except for the limited licence to use the Service under these Terms, no rights are granted.

10. Copyright complaints (DMCA)

If you believe User Content on the Service infringes your copyright, send a notice to info@silicasites.com as described on our Copyright / DMCA page at /dmca. We may remove or disable access to material and, where appropriate, terminate repeat infringers.

11. Third-party services

The Service may depend on third parties (hosting, auth, maps, email, Stripe). We are not responsible for third-party outages or their separate terms, except as required by law.

12. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY BUSINESS, CUSTOMER, REVIEW, OR LISTING IS RELIABLE OR SAFE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SilicaSites LLC, its members, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Service, disputes between users, User Content, or third-party services.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY TWELVE (12) MONTH PERIOD IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR BOOKDAH SUBSCRIPTION FEES IN THAT PERIOD, OR (B) ONE HUNDRED UNITED STATES DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED.

14. Indemnity

You will defend, indemnify, and hold harmless SilicaSites LLC and its personnel from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, your services to customers, or your breach of these Terms or applicable law.

15. Suspension and termination

You may stop using the Service at any time. You may permanently delete your account from Account settings (customers) or Settings in the business dashboard (owners). Deleting an owner login also removes that shop's public listing and related data. We may suspend or terminate access, remove content, or refuse service if you breach these Terms, create risk or legal exposure, fail to pay fees when due, or if we discontinue the Service. Sections that by their nature should survive survive termination.

16. Governing law and disputes

These Terms are governed by the State of Wyoming, United States, without regard to conflict-of-law rules. Subject to mandatory consumer protections that cannot be waived, exclusive venue for disputes arising from these Terms or the Service lies in the state or federal courts located in Wyoming, United States. You and we submit to that venue. Nothing in this section prevents SilicaSites LLC from seeking injunctive relief in any court of competent jurisdiction.

17. Changes

We may update these Terms. The “Last updated” date shows the current version. Material changes will be posted on this page. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and close your account.

18. General

These Terms, the Privacy Policy, and policies linked from them (including Cookie Policy, Community Guidelines, and DMCA) are the entire agreement between you and SilicaSites LLC regarding the Service. If a provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganisation or sale of assets. Notices to us: info@silicasites.com.
